Terms and Conditions

Swaglift Software s.r.o., with its registered seat at Korálková 1921/30, 466 01 Jablonec nad Nisou, registered in the Commercial Register kept by the Regional Court in Ústí nad Labem, file No. C 56452, Company ID (IČO): 30014336 (“Swaglift app”, “us”, “our”, “we”), operates the Swaglift mobile application for iOS and Android and the website https://swagliftapp.cz (together, the “Services”).

These Terms and Conditions (“Terms”) govern the use of the Services. Access is conditional upon your agreement with these Terms and with the Privacy Policy. You express your agreement during registration by clicking “Register” or “I agree”. If you do not agree, you are not permitted to use the Services.

1.1 Licence. We grant you a non-exclusive, limited, non-transferable licence to use the Services within the selected (free or paid) features, for the duration of the contractual relationship. The licence ends when you stop using the Services and uninstall the application.

1.2 Use restrictions. You must not, and will not allow others to: sell, sublicense, rent or distribute the Services; use them in breach of the law or third-party rights; endanger their security or functionality; reverse engineer them; penetrate them or test their vulnerabilities; upload malicious software; remove ownership notices; or use them to create a competing product.

We may suspend access during planned maintenance, upon breach of the Terms, provision of false data, breach of law, inappropriate behaviour, handling of security issues, or during changes to the Services. We reserve the right to issue updates and make changes to the Services, including making them unavailable, at our discretion.

3.1 Content licence. By uploading content (exercise videos, photos, comments) you grant us a non-exclusive, worldwide, royalty-free, sublicensable licence to use it for operating and improving the Services.

3.2 AI technique analysis. By uploading a video you agree that it will be processed by our AI algorithms for technique analysis, that anonymised data may be used to improve our models and the Service, and that the analysis will be stored in your profile. Details on processing health and biometric data are in the Privacy Policy.

3.3 Responsibility for content. You are responsible for the content you upload. Prohibited content includes pornographic, violent, racist or discriminatory content, commercial advertising without consent, content infringing third-party rights, and misleading information. We reserve the right to remove such content.

4.1 Free services. Basic features are free. Advanced AI analysis, personalised plans and detailed statistics are part of the paid services.

4.2 Paid services. The current offer (monthly subscription, discounted annual subscription, or one-off purchases) is always available in the app and on the website.

4.3 Trial period. We may offer a free trial. Activating it requires entering payment details. After it ends, the paid subscription activates automatically unless you cancel before the end of the trial.

4.4 Price changes. Price changes take effect from the next billing period. By continuing to use the Services after a change you agree to it. Otherwise you may cancel the subscription.

Use of the Services is at your own responsibility and requires good health. If you have cardiovascular, musculoskeletal, respiratory or neurological conditions, after surgery or injury, and likewise if you are pregnant, breastfeeding, or under 16, we recommend consulting a doctor. The Services do not replace medical care and we do not guarantee specific results. Swaglift app is not responsible for your health or for the suitability of exercises for your body.

We process data in accordance with the GDPR. Details are in the Privacy Policy at https://swagliftapp.cz/privacy.

7.1 Registration. You must meet the legal requirements of your country of residence, be over 16 (or use the Services under the supervision of a legal guardian), provide truthful data and keep it up to date.

7.2 Creating an account. You can create an account using Apple ID, a Google account, or email and password. When registering by email we send a confirmation email. Registration is completed by clicking the confirmation link.

7.3 Account security. You are responsible for keeping your password confidential and for activity on your account. Notify us immediately of any unauthorised use.

8.1 Formation of contract. For free services, by completing registration. For paid services, by clicking “Buy” and entering payment details.

8.2 Payments. Payments are processed via the App Store (iOS) or Google Play (Android) depending on the platform on which you make the purchase. We do not collect payment card details. In the event of a failed payment for reasons on your side, we reserve the right to charge the costs actually incurred.

9.1 Withdrawal. By completing a purchase you agree to immediate provision of full functionality and acknowledge that this extinguishes the statutory 14-day right of withdrawal for digital content, except in the case of a material breach of contract on our part.

9.2 Refunds. You may request a refund within 48 hours of purchasing a paid service. Refunds for subscriptions and purchases made through the App Store or Google Play are also handled by Apple or Google respectively under their rules, so you may also request a refund directly from the relevant store. In justified cases we may accommodate you beyond the above.

9.3 Cancelling a subscription. You can cancel your subscription at any time. Cancellation takes effect at the end of the current billing period.

Cancelling on iOS: Settings → your Apple ID → Subscriptions → Swaglift → Cancel Subscription.

Cancelling on Android: Google Play app → profile → Payments & subscriptions → Subscriptions → Swaglift → Cancel subscription.

Discounts and promotions are time-limited and governed by the terms stated with the specific offer.

We provide the Services “as is” without warranties of uninterrupted or error-free operation. We are not liable for damages from use of the Services, loss of data or revenue, reputational harm, or any indirect or consequential damages. If you breach the Terms, you will indemnify us against third-party claims arising from that breach.

We may change the Terms. We will inform you by email or in the app at least 14 days in advance. If you disagree, you may withdraw within 14 days. By continuing to use the Services you agree to the changes.

The Terms are governed by the law of the Czech Republic. We seek to resolve disputes amicably first. If no agreement is reached within 30 days, you may turn to the competent court or to the Czech Trade Inspection Authority (https://www.coi.cz) for out-of-court resolution of consumer disputes.

The invalidity of one provision does not affect the validity of the others.
